Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and KioskPro concerning your access to and use of our kiosk services, website, and related services. By accessing or using our services, you agree that you have read, understood, and agree to be bound by these Terms.

If you do not agree with all of these Terms, then you are expressly prohibited from using our services and you must discontinue use immediately.

Services

KioskPro provides self-service kiosk solutions for restaurants, including hardware rental/purchase, software licensing, installation, maintenance, and support services.

Restaurant Partners

Restaurants that partner with KioskPro agree to:

  • Provide suitable space and power for kiosk installation
  • Maintain a suitable environment for kiosk operation
  • Allow remote access for software updates and maintenance
  • Report any technical issues promptly
  • Comply with all applicable laws and regulations

Hardware and Software

Hardware Ownership

Hardware ownership depends on your service agreement:

  • Rental: Hardware remains property of KioskPro
  • Purchase: Hardware ownership transfers upon full payment
  • Hardware must not be modified, tampered with, or relocated without authorization

Software License

The KioskPro software is licensed, not sold, to you for use only in connection with our services. You may not:

  • Copy, modify, or reverse engineer the software
  • Transfer the software to third parties
  • Use the software for any unlawful purpose
  • Attempt to bypass security measures

Payment Terms

Fees

You agree to pay all fees associated with your service plan. Fees are non-refundable except as expressly stated in your agreement.

Payment Methods

We accept payment by credit card, bank transfer, and other methods specified in your agreement. You authorize us to charge your payment method for all fees incurred.

Late Payments

Late payments may result in service suspension or termination. We may charge interest on overdue amounts at the rate of 1.5% per month.

Support and Maintenance

Technical Support

We provide technical support according to your service plan. Support is available during business hours unless otherwise specified.

Maintenance

We will perform regular maintenance and updates to ensure optimal performance. Some maintenance may require temporary service interruption.

Hardware Warranty

Hardware comes with a limited warranty as specified in your agreement. Warranty does not cover damage from misuse, accidents, or unauthorized modifications.

Limitation of Liability

In no event shall KioskPro be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability shall not exceed the amount paid by you for our services in the twelve months preceding the claim.

Termination

Either party may terminate this agreement with written notice. Upon termination, you must return any rented hardware and cease use of our software.

We may suspend or terminate your access to our services immediately if you violate these Terms or engage in fraudulent activity.

Changes to Terms
